Know all men by these presents that we Horace B Parker of Newton in the county of Middlesex and State of Massachusetts and Henrietta M Parker, wife of the said Horace B. Parker in her own right in consideration of one dollar and other good and valuable considerations paid by Charles S. Keene of said Newton the receipt of which is hereby acknowledged do hereby – release and forever quitclaim until the said Charles S. Keene and his heirs and assigns a certain parcel of land in that part of said Newton called Newtonville being lots numbered as 58, 59, 60, 61, and 62 on a plan by E. S. Smilie dated January 1887 to be recorded with Middlesex South District Deeds bounded and described as follows: Easterly and Southeasterly by Grove Hill Avenue 495 ft Southerly by lot numbers 63 on said plan 150 ft Westerly and southwesterly by lots numbered 69, 70, and 71 on said plan 379.4 ft and southwesterly by a foot path six feed wide shown on said plan 156.1 ft containing 61,910 sq ft.
Also a certain other parcel of land being lot numbered 70 on the plan aforesaid bounded and described as follows westerly by Grove Hill Park 110ft northerly by lot 69 on said plan 132 ft easterly by lots 60 and 61 on said plan by two lines of 76.9 and 73.3 ft respectively and southerly by lot numbered 71 on said plan 139.6 containing 18,040 sq ft.
The said premises are conveyed subject to the following assignment: A dwelling house costing not less than $4000 shall be built by the purchaser on each of the said lots of land within 2 years from this date and subject to restrictions which all remain in force for the term of 25 years from the 4th day of July 1885 as follows. No Building shall be erected on the said land except dwelling housees on each of said lots with usual out buildings adapted to the use of not more than two families with private stable if desired, and but one house shall be erected on each of the said lots such buildings shall be set back at least 25 feet from the line of Grove Hill Ave.
No building upon said land shall be used for carrying on any trading, manufacturing, or mechanical business for a livery stable or as a tenement house. The said premises are to be conveyed subject to the taxes assessed May 1, 1887, which the grantor agrees to pay. To have to hold the above released premises with all the privileges and — to the same belonging to the said Charles S. Keene his heirs and assignees that the premises are free from all encumbrances made or suffered by us except as aforesaid and that we will and our heirs expectation and administrators shall warrant and defend the same to the said Charles S. Keene his heirs and assigns forever against the lawful claims and demands of all persons claiming by through or under us but against more than other except as aforesaid.
In witness whereof we the said Horace B. Parker and Hennreietta M. Parker have hereunto set our hands and seals this 9th day of May in the year of our lord 1887 Horace B Parker (seal) Henrietta M Parker (seal) Signed sealed and delivered in presence of Issac F. Hengury to both loom commonwealth of Mass Middelsexc ss May 9th 1887.
